Delhi High Court Directs Expedited Trial in Haryana Judicial Exam Paper Leak Case

Synopsis

The Haryana Judicial Exam Paper Leak matter was transferred from Chandigarh to Delhi by the Supreme Court. The trial court is now expected to conclude the matter on or before April 15, 2024

The Delhi High Court has instructed the trial court to expedite the proceedings regarding the leaked Haryana Civil Services Judicial (HCS (JB)) examination papers.

The Supreme Court had transferred the case from Chandigarh to Delhi, acknowledging the gravity of the issue.

The bench of Justice Dinesh Kumar Sharma emphasized the seriousness of the matter and asked the trial court to expedite the proceedings, aiming for resolution by April 15, 2024. The parties involved have agreed to collaborate for a swift trial.

“This is a serious matter involving the leaking of judicial examination papers. The matter was transferred from Chandigarh to Delhi by virtue of the orders of the Apex Court. The learned trial court is expected to expedite the matter and take the same on a day-to-day basis," the court said. 

Advocate Alok Bhachawat represented the petitioner, while Additional Public Prosecutor Charanjit Singh Bakhshi appeared for the respondent.

During the proceedings, the petitioner expressed a willingness to withdraw the petition, reserving the right to summon specific documents during the defense evidence stage.

These documents pertain to the HCS (JB) Examination 2017 preliminary inquiry and include letters, summons, and emails sent by the Registrar Vigilance to various individuals and mobile companies.

The respondent suggested that the petitioner could file a suitable application before the trial court during the defense evidence stage for further consideration.

Taking note of the submissions, the court disposed of the petition, granting the petitioner the liberty to submit an appropriate application during the defense evidence stage to summon the specified documents, with the trial court expected to decide on this matter in accordance with the law.

“In view of the submissions made, the present petition is disposed of with the direction that the petitioner shall be at liberty to move an appropriate application at the stage of defence evidence for summoning the aforementioned documents. Learned trial court shall decide the same in accordance with law," the court ordered.
