Plea in Calcutta High Court against “provocative”, “inflammatory” statements against PM Modi by West Bengal CM Mamata Banerjee

Synopsis

The plea has sought protection for the members of ruling party in the central government in vicinity of the area where provocative speeches were given by CM Mamata Banerjee

Bhartiya Janta Party leader Nazia Elahi Khan has moved the Calcutta High Court against West Bengal Chief Minister Mamata Banerjee over the issue of various provocative and inflammatory remarks against the Prime Minister of India Narendra Modi and other members of the BJP.

The plea alleged that on the eve of Independence day, CM Banerjee on a non-political platform used provocative, scandalous, insulting remarks against the Prime Minister.

The speech was also against Media Channels including YouTube Channels, Har Ghar Tiranga Programme, and even intimidated the members of the Ruling Party in the Central Government by stating that if one Anubrata Mandal is arrested then lakhs of Anubrata Mandal can be born by using the term Royal Bengal Tiger, the plea adds (TMC leader Anubrata Mandal has been arrested by Central Bureau of Investigation in a cattle smuggling case).

It states that the members of the Ruling Party in the State of West Bengal vehemently campaign against the Ruling Party in the Central Government and it has been seen how these campaigns become quite violent and there is a serious apprehension of the breach of peace and tranquillity in those areas wherein the campaigns would take place.

Given the above, the plea has sought the following directions: 

1. Take legal steps against CM Banerjee in the same way as a Police Official has been entrusted to take as per the provisions of the Code of Criminal Procedure, 1973 even by apprehending her through arrest;

2. Provide protection to the members of the Ruling Party in the Central Government in the vicinity of the area where rallies/ campaigns are undertaken by the Ruling Party in the State of West Bengal; and

3. Maintain peace and tranquillity in the areas where the campaigns are being conducted by the members of the Ruling Party in the State of West Bengal.
