[Terror Funding Case] Delhi High Court to hear plea by Kashmiri Separatist leader Naval Kishore Kapoor on September 5

Synopsis

A bail application has been filed by the Kashmiri separatist leader in a case over his alleged involvement in terror funding. It will be taken up for hearing on September 5. 

The Delhi High Court on Tuesday posted the bail application filed by Kashmiri separatist leader Naval Kishore Kapoor, an accused in a terror funding case, for hearing on September 5.

During the hearing today, Advocate Sahil Dutta appearing for Kapoor submitted, “We have filed the compilation report”. He sought an adjournment as Senior Advocate Colin Gonsalves, who is to argue the matter was indisposed at the moment.

The division bench comprising Justice Siddharth Mridul and Justice Gaurang Kanth said, “At the request of Mr. Sachin Dutta, learned counsel appearing for the petitioner on the ground that Mr. Colin Gonsalves, learned senior counsel who has to address arguments in the present appeal is indisposed. For hearing for the same, adjourn the matter”.

The bail application has been filed by Kapoor in connection with Jammu & Kashmir terror funding and secessionist activities case. Recently, in this case, Yasin Malik was awarded life imprisonment. Kapoor has been charged for offences under the provisions of the Unlawful Activities (Prevention) Act.

Earlier, the court framed charges against Kashmiri separatist leaders along with Kapoor who are accused in the case, including Farooq Ahmed Dar alias Bitta Karate, Shabbir Shah, Masarat Alam, Md Yusuf Shah, Aftab Ahmad Shah, Altaf Ahmad Shah, Nayeem Khan, Md Akbar Khanday, Raja Mehrajuddin Kalwal, Bashir Ahmad Bhat, Zahoor Ahmad Shah Watali, Shabir Ahmad Shah, and Abdul Rashid Sheikh.

It may be noted that Malik- the flag bearer of JKLF on May 10, had pleaded guilty before the NIA court to all charges under the Unlawful Activities (Prevention) Act.

In 2016, Malik along with other Hurriyat leaders had formed a self-styled group called 'Joint Resistance Leadership', whereby they started issuing directions to the masses to hold protests, demonstrations, hartals, shutdowns, road-blocks and other disruptive activities which intended to push the entire society into chaos and lawlessness.

Malik was also involved in raising funds from LOC traders, and various entities based abroad and distributing those funds among militants and stone-pelters for funding stone-pelting and demonstrations.

He was chargesheeted for his involvement in the offences under sections 120B, 121, 121A & 124A of IPC and Sections 13, 16, 17, 18, 20, 38 & 39 of UA(P)Act, on April 10, 2019.
