A complaint has been filed with the President of India under Articles 102 and 103 of the Constitution, seeking the disqualification of Asaduddin Owaisi from his position as a Member of Parliament.
Advocate Hari Shankar Jain filed the complaint on June 25, the same day Mr. Owaisi, immediately after taking his oath as a Member of the Lok Sabha representing the 9-Hyderabad Parliamentary Constituency, raised the slogan “Jai Palestine” from the same stage.
The complaint argues that "Palestine is a foreign state, and no citizen of India can show allegiance or adherence to it."

"It is a very serious matter and a threat to national security," the complaint stresses.
It emphasises that the provision under Article 102(1)(d) is intended to prevent anyone from becoming a member of Parliament if they show allegiance to a foreign state, thus ensuring the sovereignty and integrity of India, which are fundamental requirements for holding any constitutional responsibility.
The complaint underscores that Mr. Owaisi's slogan poses a threat to the security, sovereignty, and integrity of the nation, describing the issue as extremely serious and critical, requiring immediate attention and action under Articles 102 and 103 of the Constitution.
The complaint therefore seeks the disqualification of Mr. Asaduddin Owaisi for demonstrating allegiance to a foreign state, specifically Palestine. It also calls for the opinion of the Election Commission of India regarding the disqualification of Mr. Owaisi.
