Synopsis

A petition has been filed in the Allahabad High Court seeking registration of a criminal case against Prime Minister Narendra Modi, Home Minister Amit Shah, BJP President JP Nadda, and other BJP leaders. The petition alleges that their promotion of the Citizenship Amendment Act (CAA) contributed to violence and riots.

Khurshid Ur Rahman from Aligarh previously filed a complaint on this issue under Section 156(3) of the Code of Criminal Procedure (CrPC) in the Aligarh District Court. However, this initial complaint was dismissed by the Chief Judicial Magistrate (CJM) of Aligarh, and a subsequent review petition was also rejected by the Aligarh Sessions Court.

Rahman claims that by using public speeches, billboards, and widely circulated magazine articles to support the CAA, these leaders abused their positions and broke their oaths of office. He alleges  that the BJP's promotional campaign for the CAA was a calculated effort to manipulate public sentiment and provoke unrest.

The petition claims that the BJP's promotion of the CAA led to widespread unrest, resulting in large-scale protests, riots, and violence across India. These incidents caused significant damage to public and private property and resulted in the loss of several lives.

In his petition, Rahman points to an article published in a BJP-supported magazine, which he claims serves as evidence of a conspiracy by BJP leaders to incite violence and religious sentiments for their political benefit.

Now, Rahman has moved the Allahabad High Court, challenging the orders of the courts below.

The petition seeks the high court's intervention to overturn the decisions of the Aligarh District Court and the Sessions Court and demands the registration of a criminal case against the BJP leaders involved.
