Synopsis

"5th August, 2019 and today’s date will go down in the history of India when a Himalayan constitutional blunder of the past with gigantic proportion is ultimately corrected by the Government", SG Mehta has expressed

Solicitor General of India Tushar Mehta has reacted to the Supreme Court's verdict upholding the abrogation of Article 370, saying it is a historical day for him too.

"Being the only lawyer involved in the process of abrogation of Article 370 through constitutional and legal means before 5th August, 2019 and having led the arguments before the Constitution Bench of the Supreme Court while defending the constitutional process, it is a historical day for me too", the SG has said.

SG Mehta has referred to the judicial adjudication by the Supreme Court to be 'also equally historical and rare'.

"It is only the iron will of our Hon’ble Prime Minister Shri Narendra Modiji and resolute decisiveness and brilliant strategy of our Hon’ble Home Minister Shri Amit Shahji which made this historical decision possible. The nation will ever remain indebted to them. I have had the good fortune of witnessing and being a part of the entire process which exhibited their exemplary resolve coupled with minute coordination of the smallest details and flawless and scientific stewardship of the parliamentary process and floor management inside the House", the second-highest law officer of the country adds.

In a historic verdict, the Supreme Court of India today has upheld the abrogation of Article 370 of the Constitution of India which accorded "special status" to the erstwhile state of Jammu and Kashmir.

Court has held Article 370 to be a temporary provision enacted introduced to serve a transitional purpose considering the war conditions in the state of Jammu and Kashmir. A textual reading of the article also indicates that it is a temporary provision, CJI Chandrachud added.

A five judge Constitution bench comprising of CJI DY Chandrachud, Justices SK Kaul, Sanjiv Khanna, BR Gavai and Surya Kant had reserved verdict on September 5, 2023. Court had begun hearing the case on July 11.
