Supreme Court dismisses plea for postponement of GATE 2022 due to Covid-19 lockdowns

A Supreme Court bench of Justices Chandrachud, Surya Kant and Vikram Nath today dismissed a plea seeking postponement of Graduate Admission Test 2022. The bench held that the plea for postponement barely 48 hours before the scheduled date of the examination is replete with potential for chaos and uncertainty in the lives of the students.

When the matter came up for hearing Justice Chandrachud immediately remarked, “We can’t start postponing exams like this! We can’t play with the lives of the students. In your petition there is someone who runs a coaching class!”

Adv. Pallav Mongia appearing for the petitioner submitted that the rules of the exam mandate that any person with symptoms can appear, and this will push the students to just take medicines and appear for exams.

Justice Chandrachud further remarked that “Nine  lakh you say are appearing. It’s dangerous for the Court to step into this arena. Students have prepared, there will be chaos in the country.”

The counsels however tried to convince the Court that they have been diligent in approaching the Court as the admit cards were issued only on January 15, 2022 and they approached the Court almost immediately.

The Court was however not convinced and dismissed the petition, holding, “There is no overarching reason why this Court should sub-plant the duties and functions of the regulatory authorities. On a considered perspective of the position and consistent with the circumspection with respect to academic matters, the petition is dismissed.”
