‘Family Being Pressurized for Religious Conversion Following Minor Daughter’s Rape’, Allahabad High Court Denies Bail to the Accused

Stressing over the seriousness of the matter of a 14-year girl being raped and afterward the entire family being pressurized to convert their religion a Single Bench of Allahabad High Court comprising Justice Ajit Singh on Thursday rejected the bail application of one Abdul Rahman.

The Gist of the matter

As per the FIR, allegedly Rehman entered the house of the girl when she was alone and forcibly raped her. It is also alleged that Rehman made a video clip of the victim and pressurized her for establishing physical relation again.

When the father of the girl (Complainant) asked Rehman’s father to get the video clip deleted, he said that when the complainant’s entire family will convert the religion then Rehman will marry his daughter else he himself will marry her, the FIR adds.

Rahman has been booked in a case registered under sections 452/376/120-B IPC, and section 3/4, 17/18 POCSO Act, and section 3/5(1) U.P. Prohibition of Unlawful Conversion of Religion Act 2020 and section 66E Information Technology (Amendment) Act.

Averments of the parties

The counsel of the accused submitted that the accused was innocent and he had been falsely implicated in the matter due to partybandi of the locality.

He further submitted that the accused has no criminal history and he is languishing in jail since January, 26 and in case he is released on bail, he will not misuse the liberty of bail and will cooperate in the trial.

The AGA vehemently opposed the prayer in the bail application contending that that video clip which was made of the minor victim had been taken in possession by the police during the investigation.

He added that the girl was a minor aged about 14 years and the accused and his family also tried to pressurize the victim's family to get their religion converted.

Court order

Rejecting the bail, the Single Bench held,

“After considering the facts and circumstances of the case and considering the seriousness of the matter and minor daughter was raped and the entire family was asked to convert their religion, without expressing any opinion on the merits of this case, this court does not deems it fit to release the applicant on bail.”
