Arvind Kejriwal’s bail stayed by judge related to ED counsel, lawyer expresses suspicion

With Delhi Chief Minister Arvind Kejriwal's bail being stayed by the Delhi High Court recently, a lot of murmur is making the rounds about the High Court granting a stay in an extremely irregular fashion.

An allegation has also been made about Justice Sudhir Kumar Jain of the Delhi High Court, who issued the stay, being related to the counsel of Enforcement Directorate.

Notably, a representation has been addressed to the Chief Justice of India DY Chandrachud question the Enforcement Directorate's challenge, made on the very next day, before the High Court, challenging the order of Additional Session Judge Nyaya Bindu granting bail to Delhi Chief Minister Arvind Kejriwal.

"What makes this challenge extremely irregular is the fact that the challenge was done even before the Rouse Avenue Court order was uploaded. This raises the question as to how Hon’ble Justice Sudhir Kumar Jain before the order was uploaded allowed the mentioning of a challenge to said order, allowed it to be listed and most worrying ordered a stay on the execution of the bail bond. All of this was done even before the order was uploaded. Something like this has never been seen in the history of
the Indian judiciary before this. And this has raised deep concerns in the mind of the legal fraternity....",
the representation adds.

Very recently, Aam Aadmi Party's Sanjay Singh has also said the Central Bureau of Investigation (CBI) has been misleading the Supreme Court of India as CBI arrested Chief Minister Kejriwal for the sole reason of keeping political opponents in jail. Singh has also claimed the ED and CBI to be weapons of the Central government.

Kejriwal was recently arrested by the CBI, after the High Court had overturned the decision of the vacation bench of the Rouse Avenue Court that granted bail to the Chief Minister in the ED case. 

Rouse Avenue Court has now also permitted the Central Bureau of Investigation to interrogate Kejriwal concerning the now defunct liquor excise policy.

The Delhi CM was arrested on March 21st this year. He obtained bail from the Supreme Court for his election campaign but failed to extend this relief in subsequent appeals. Finally, the trial court granted him regular bail on June 20.

Notably, Rouse Avenue Court granted bail to Kejriwal, criticizing the ED for bias and failure to directly link him to proceeds of crime in the excise policy case. 

The case against Kejriwal & allies involves allegations of corruption and money laundering in the formulation and execution of Delhi's excise policy for 2021-22, which was later scrapped.
